Governing Laws for Legal Action

Agreeing to the Terms and Conditions of ETR  acknowledges that you understand that any legal action that may take place due to violation of our Terms and Conditions will be governed by the laws of the United States of America and the state of Illinois. Any legal process or preceding which results in a response to violations of our Terms and Conditions will be brought exclusively in a federal or state court of competent jurisdiction in the state of Illinois.

ETR  will pursue all violators that breach any of the Terms of Service presented.
In the event that legal action needs to take place by either party for the purposes of enforcing and/or arguing against any condition laid out in the Terms and Conditions at ETR , ETR  will be entitled to receive compensation including but not limited to the result of a monetary award in the judgment, decision, any type of resolution, proceeding or arbitration in either party’s favor, for reasonable attorney’s fees, expenses (including travel and lodging) any court costs that result from the particular legal proceeding.

Accountability for Equipment

By accepting these Terms and Conditions, you agree that immediately upon the arrival of your equipment, you will thoroughly inspect all equipment and/or accessories and immediately notify ETR  of any type of damages (regardless of how minimal they appear), malfunctions, missing accessories or components. Contacting us immediately will allow us to take appropriate measures on the situation and will avoid conflicts in fault between you, the customer, and the shipping service. Once the equipment is in your possession, you are held fully accountable for any damages to the equipment, lost or stolen equipment, or misuse that result in the harming or damaging of the equipment.

You can cancel your order seventy-two hours before your rental period begins. If you wish to cancel your order after your equipment has been shipped, you will be charged the full round-trip shipping price but will be excused from your rental period costs. However, when the equipment arrives at your desired location you must reject the package and must not sign for the package.

Security Deposit Policy

ETR  reserves the right to require a security deposit up to the amount of 100% of the current market replacement cost of the equipment being rented. ETR reserves the right to decide whether or not to disclose reasons for requiring a security deposit from a customer. Reasons that typically result in a requirement for a security deposit include, but are not limited to, ETR  being unable to use www.electronicverificationsystems.com to correctly verify: a customer’s mailing address, email address, telephone number, fax number, place of business, the location where the equipment is to be shipped, payment method, official website, and a proper state-issued form of identification.

Net 30 Terms

ETR  allows customers in accordance with Net 30 terms, thirty days (including holidays and weekends) to pay in full for all services and rental costs. Customers will not be eligible for the Net 30 Terms for personal rental use and all customers who wish to use the Net 30 terms must complete an application and it must be approved. The Net 30 Terms will come into effect the day a customer’s rental period begins. If payment in full is not received by ETR for all services rendered and complete costs of the rental purchase, a 5% finance charge will be assessed to the total rental purchase cost each week that payment in full is not received by ETR . The finance charges after the thirty-day period will not compound. If ETR  does not receive payment in full from a customer for the total costs of services rendered after ninety days, the customer’s account will be placed on hold and their total charges (including finance charges) will be sent to www.nationalmanagement.net for collections. The customer will then be liable for all charges including the total cost of services rendered and finance charges from ETR  as well as all charges and fees associated with the collection agency.

Credit Card Policy

We accept the following major credit cards: Visa, MasterCard, American Express and Discover. All credit cards will be verified through www.dataxltd.com before the order can be processed or shipped. If for any reason we are unable to properly verify a customer’s credit card, the order will be considered canceled. The customer can then speak with us directly at 1-866-840-1472 to discuss the situation and the possibility of an alternative form of payment.
